By purchasing an NOTHING 4a Black 8+128 (A10400282), White 8+128 (A10400284), Black 8+256 (A10400312), White 8+256 (A10400313), Black 12+256 (A10400283), White 12+256 (A10400285), Blue 12+256 (A10400286), Pink 12+256 (A10400287) through a Participating Retailer, you accept and agree to these terms and conditions.

Participating Retailer means JB Hi-Fi, The Good Guys, Optus & Amazon.com.au. Amazon.com.au purchases must be made on Amazon.com.au. Purchases made through any other Amazon marketplace (including, but not limited to, Amazon.com, Amazon.co.uk, or Amazon.co.jp) are not eligible, even if shipping was made to an Australian address. Amazon.com.au Proof of Purchase must indicate Amazon’s Australian ABN and sold by Amazon Commercial Services Pty Ltd.

The Promotion Period begins at 9:00AM (AEDT) on 6th March 2026 and ends at 11:59PM (AEDT) 16th March 2026.

NOTHING reserves the right in its sole discretion to cancel, terminate, modify, or suspend this promotional offer at any time for any reason without notice.

You must be aged 18 years or older at the time of purchasing the Eligible Product to be eligible to claim under this promotional offer. Business customers and employees of NOTHING and participating retailers and their related bodies corporate are ineligible to claim under this promotional offer.

This promotional offer is available to the original purchaser of the Eligible Product only and cannot be transferred to any other person. It also cannot be exchanged for cash or any other products.

As the purchaser of an Eligible Product, you may submit a claim for Gift(s) including: one (1) NOTHING Ear (a) with a Recommended Retail Price (RRP) of $169.00 (incl GST) OR one (1) CMF by Nothing Watch 3 Pro with a Recommended Retail Price (RRP) of $179.00 (incl GST). You may submit a claim by visiting our distribution partners website at https://www.dickerdata.com.au/nothing/phone-4a-preorder-offer completing all requested information in the online redemption form, including providing your personal details (such as name, date of birth, address), providing proof of purchase details (such as receipt of purchase) as well as activation details of the Eligible Product (such as device IMEI number) between 9:00AM (AEDT) on 6th March 2026 and ends at 11:59PM (AEDT) 1st May 2026. An individual may submit a maximum of one (1) claim for the Gift(s), and NOTHING may in its sole discretion reject any second or subsequent claim for the Gift(s).

PROCEDURES RELATED TO PRODUCT RETURNS AND EXCHANGES

Returns and exchanges of the Eligible Product and the promotional offer are subject to the policy of Participating Retailer where the purchase was made, as well as to the protections provided by the Australian Consumer Law. If the Eligible Product is returned or exchanged for an ineligible product, the Gift(s) must also be returned in its original packaging. Otherwise, the amount of the Recommended Retail Price (RRP) of the Gift(s) (“Promotion Savings”) will be deducted from the return or exchange.

Once the Gift(s) has been submitted and claimed, no change of mind will be allowed, and no exchanges will be permitted. However, if the full retail value of the desired product is less than the original Promotion Savings, the qualified purchaser will not receive credit for the difference.

PROMOTION RESTRICTIONS

For eligible purchases made at participating retailers, you must demonstrate that you meet the requirements prior to your purchase. Public entities, government entities, non-profit organizations, enterprise purchasers, and business purchasers do not qualify, and NOTHING reserves the right to cancel purchases made by such purchasers. In the unlikely event that the specified Gift(s) are unavailable, NOTHING may provide a substitute item of equal or greater value, subject to stock availability.

Claims will be assessed within 3 days of submission and claimants will be contacted via email should the claim be rejected or require further information. Successful claimants should allow up to sixty (60) days for delivery of the Gift(s) from the date they receive notification from NOTHING and Dicker Data that they have submitted a valid Eligible Claim. NOTHING will use reasonable endeavours to deliver the Gift(s) within sixty (60) days of the purchase date, extended timeframes may occur during high-demand periods or due to factors outside NOTHING’s control, such as freight delays or network disruptions. NOTHING is not responsible for any delay once the Gift(s) have been handed over to the nominated courier or retail fulfilment partner, except as required under the Australian Consumer Law. Gift(s) will be delivered to mailing address submitted at the time of submitting an Eligible Claim.

DELIVERY OF GIFT(S)

Delivery timeframes may vary based on stock availability, delivery address, and courier schedules.

Gift(s) cannot be delivered to PO Boxes, Parcel Lockers, or Locked Bags. Customers must provide a valid Australian address at the time of purchase. NOTHING and its fulfilment partners are not responsible for any loss or delay resulting from an incomplete or inaccurate delivery address.

OTHER RESTRICTIONS

Without limiting these terms, NOTHING may cancel, terminate, modify or suspend this promotional offer at any time. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy under the Australian Consumer Law. NOTHING is not liable for any loss, damage or personal injury suffered or sustained as a result of this Offer.
